$11 Million for Underage, Intoxicated College Student Hit by Car in Florida
A 19 year old Florida Atlantic University college student attended College Night at Blue Martini in Boca Raton, Florida, with several of his friends. Blue Martini failed to properly check his identification and verify his age, and served him copious amounts of alcohol. After leaving the bar and while walking back to his dorm intoxicated, he was hit by a car while attempting to cross a street in the wee hours of the morning, suffering a traumatic brain injury (TBI). Although Blue Martini was not the driver of the car, its actions in luring underage patrons to its bar on “College Night” were just as much to blame. Uncovering social media posts by Blue Martini and its agents marketing college nights to college freshmen helped to prove liability and its insurers ultimately tendered the limits of its insurance, $11,000,000.
