The Montreal Convention holds air carriers automatically liable for proven damages up to a limit specified in treaty: 113,100.00 Special Drawing Rights (which act as a foreign exchange alternative to currency) or about $170,000 as of 2019. Passengers injured on international flights could be entitled to even more damages, but the air carrier may avoid liability by proving the accident was not caused by their negligence.
