A woman in her mid-forties was hit from behind in a rear-end car accident in Broward County, Florida. She had prior history of neck and back injuries which were aggravated as a result of the accident. The other driver had very little insurance, so she made a claim under her uninsured/underinsured motorist insurance, which had a $60,000 limit. Her insurer refused to pay in bad faith, claiming her injuries were pre-existing. A jury returned a $430,000 verdict in her favor, seven times the coverage under her insurance policy.
