Pedestrian Hit Crossing the Street

A man in his seventies was visiting Florida with his family, staying in Fort Lauderdale before heading to the Florida Keys. While walking across the street in a properly marked crosswalk, he was hit by a woman driving an SUV who was not keeping a proper lookout and was talking on her cell phone. He suffered a broken arm and aggravation of pre-existing neck pain. We sued the driver in federal court where the insurer settled for $630,000.
