Miami Commissioner Jose “Pepe” Diaz

Key West – May 4, 2016 – Mase Lara attorneys Chris Lyons and Eric Hayden got a not guilty verdict in the DUI trial of Miami-Dade County Commissioner Jose ‘Pepe’ Diaz. Diaz was charged with DUI in Key West back in September after being pulled over for speeding on his Harley-Davidson down Roosevelt Boulevard. Police dashcam video showed the stop and captured Diaz telling the officer about his elected position. Police said Diaz refused to take a breath test, and failed a roadside sobriety test, staggering and unable to stand straight. But at trial, his defense team, made up of Lyons and Hayden, argued that Diaz stumbled because of his weight and other physical limitations – and because he burned his leg on the motorcycle tailpipe.

“Lebron James couldn’t do these roadside sobriety exercises,” Lyons told the jury, “We believe the police and prosecutors did not meet their burden.”

The jury agreed with Lyons and, after only 20 minutes of deliberation, came back with a not guilty verdict.
